Special laws apply to military divorces
If you are considering divorce and are a military member or the spouse of a service member, you should know the following:
- The Uniformed Services Former Spouses' Protection Act permits military pensions to be divided between the military member and the spouse, so long as certain requirements regarding length of marriage and length of active duty are met. The pension is often the largest asset divided in a military divorce, and it is a complex area of law requiring a document called a constituted pension order.
- The Servicemember's Civil Relief Act gives certain rights to active-duty military members during divorce proceedings. For example, an active-duty service member may be able to complete his or her divorce without appearing in court, if leave to appear in court would interfere with his or her official duties.
- Child custody, parenting plans and visitation rights are also complex in military divorce cases. Some states are enacting legislation prohibiting final custody orders from being entered during a service member's deployment.
